1. Overview

Tovah Marketplace is an online multi-vendor marketplace that connects independent sellers (“Vendors”) with customers (“Buyers”). Tovah Marketplace operates solely as a technology platform and intermediary and is not a party to transactions between Buyers and Vendors.

2. Marketplace Role and Disclaimer

Tovah Marketplace is not the seller of record for most products listed on the platform.

• We do not manufacture, store, inspect, or guarantee products
• All products are listed and sold by independent Vendors
• We do not guarantee product quality, safety, legality, or accuracy

All transactions are solely between Buyers and Vendors.

To the fullest extent permitted by law, Tovah Marketplace disclaims all liability arising from:

• Products sold by Vendors
• Vendor conduct or communications
• Shipping delays, damages, or losses
• Errors, inaccuracies, or misrepresentations in listings

3. Vendor Responsibility

Vendors are solely responsible for:

• Ensuring they have full legal rights to sell listed products
• Providing accurate descriptions, pricing, and images
• Compliance with all applicable laws and regulations
• Order fulfillment, shipping, and delivery
• Customer service, returns, and refunds

Tovah Marketplace reserves the right to suspend, restrict, or terminate Vendor accounts or listings at any time, for any reason, without notice.

4. Intellectual Property

All content, including artwork, product designs, images, and listings, remains the intellectual property of the respective Vendor or rights holder.

By listing items, Vendors represent and warrant that:

• They own or are authorized to use and sell the content
• Their listings do not infringe on any third-party rights

Tovah Marketplace does not verify ownership but reserves the right to remove content at its sole discretion.

5. DMCA and Copyright Infringement

Tovah Marketplace complies with applicable copyright laws.

If you believe your copyrighted material has been used without authorization, you may submit a notice including:

• Your contact information
• Description of the copyrighted work
• URL or location of the alleged infringement
• A good faith statement
• A statement under penalty of perjury

We may remove or disable access to content upon receiving a valid claim.

6. Orders and Payments

• Payments are processed through third-party providers
• Tovah Marketplace does not store full payment details
• Vendors are responsible for fulfilling all orders

We are not responsible for payment failures, processor errors, or disputes.

7. Shipping

Shipping policies are determined by individual Vendors.

Tovah Marketplace is not responsible for:

• Shipping delays or failures
• Lost, stolen, or damaged items
• Customs, duties, or international restrictions

8. Returns, Refunds, and Disputes

Return and refund policies are set by each Vendor.

• Buyers must follow Vendor policies
• Tovah Marketplace is not required to issue refunds
• We may assist in disputes at our discretion but are not obligated

9. Chargebacks and Payment Disputes

Users agree not to initiate unjustified chargebacks.

If a chargeback is filed:

• We reserve the right to suspend or terminate accounts
• We may provide transaction data to payment processors
• You agree to reimburse any fees, losses, or damages incurred

10. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account
• All activity under your account

We reserve the right to suspend or terminate accounts at any time without notice.

11. Prohibited Activities

You agree not to:

• Use the platform for unlawful purposes
• Upload false, misleading, or infringing content
• Attempt to hack, disrupt, or exploit the platform
• Circumvent payment or platform systems

12. Platform Availability

We do not guarantee uninterrupted, secure, or error-free operation of the platform.

We may modify, suspend, or discontinue any part of the platform at any time without liability.

13. Limitation of Liability

To the fullest extent permitted by law, Tovah Marketplace shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or data
• Business interruption
• Any damages arising from platform use or vendor transactions

Your use of the platform is at your own risk.

14. Indemnification

You agree to indemnify and hold harmless Tovah Marketplace, its owners, affiliates, and operators from any claims, damages, liabilities, or expenses arising from:

• Your use of the platform
• Your violation of these Terms
• Your infringement of any rights

15. Modifications to Terms

Tovah Marketplace reserves the right to modify, update, or replace these Terms and Conditions at any time, in its sole discretion, without prior notice.

Any changes will be effective immediately upon posting on this page.

Your continued use of the platform constitutes your acceptance of those changes.

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio.

17. Arbitration and Dispute Resolution

Any disputes arising out of or relating to these Terms or the use of the platform shall be resolved through binding arbitration in the State of Ohio.

You agree to waive any right to:
